Terms of service
These terms apply to your use of InWriting, operated by Tuohy Labs LTD.
1. The service
InWriting lets you create quotes, share them with your customers for online approval, record amendments and raise invoices. We provide the software; you remain responsible for the accuracy of the prices, descriptions, VAT treatment and contractual terms you send to your customers.
2. Your account
You must provide accurate business details and keep your login credentials secure. You are responsible for all activity carried out under your account, including by anyone you invite to it.
3. Subscription, trial and payment
New accounts start with a 14-day free trial. No payment is taken during the trial and you can stop before it ends without being charged. After that, access to the quoting, approval and invoicing features requires an active subscription at £29 per month or £290 per year, billed in advance and renewing automatically until cancelled. Prices may change with at least 30 days' notice before your next renewal.
Payments are taken by Stripe. Tuohy Labs LTD is not currently VAT registered, so no VAT is charged on your subscription and no VAT is shown on our receipts.
3a. Cancellation and refunds
You can cancel at any time from your billing settings, which opens Stripe's secure billing page. Cancelling stops the next payment and you keep full access until the end of the period you have already paid for. We do not refund part-used months or years, except where a refund is required by law or where you were charged in error - raise a support request from the support page in your account and we will put it right. If you are a consumer exercising a statutory right to cancel within 14 days of first payment, tell us and we will refund that payment, less a proportionate amount for the service already used at your request. Failed payments are retried; if they keep failing, the subscription ends and the account reverts to read-only access to your existing records.
4. Your customers' data
Where you store details of your own clients in InWriting, you are the data controller and we act as your processor. We process that information only to provide the service to you.
5. Quotes, approvals and records
Once a quote is sent it is stored as a fixed record of exactly what your customer was shown. Approvals record the version approved, the name entered by the approver and the time of approval. These records are intended to help you evidence agreement; they are not legal advice and do not replace a written contract where one is required.
6. Acceptable use
You must not use InWriting to send unlawful, misleading or unsolicited communications, to impersonate another business, or to attempt to gain unauthorised access to the service or to other accounts.
7. Availability and liability
We work to keep the service available but do not guarantee uninterrupted access. To the extent permitted by law, our total liability to you is limited to the subscription fees you paid in the twelve months before the claim. We are not liable for lost profits or for the commercial outcome of any quote you send.
8. Ending your subscription
You may cancel from your billing settings. We may suspend or end access where these terms are breached. Your data is retained for a limited period after cancellation so it can be restored or exported, then deleted subject to any records we must keep by law.
9. Changes and governing law
We may update these terms and will notify you of material changes. These terms are governed by the law of England and Wales, and its courts have exclusive jurisdiction.
10. Contact
Account holders can raise questions about these terms from the support page inside their account, where we reply and keep a record of the conversation. Written enquiries can be sent to Tuohy Labs LTD, 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ.
